1. Acceptance of Terms

By downloading, installing, or using Retro (the "App"), you agree to be bound by these Terms of Service. These Terms form a legally binding agreement between you and Digital Charm ("we," "us," or "our").

If you do not agree to these Terms, please do not use the App. These Terms apply to all versions of Retro available on iOS, macOS, Android, and Windows.

2. License to Use

Subject to these Terms, Digital Charm grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial purposes.

This license does not include the right to:

• Modify, copy, or create derivative works of the App
• Reverse engineer or decompile the App
• Rent, lease, lend, sell, or sublicense the App to any third party
• Remove any proprietary notices or labels on the App

3. In-App Purchases & Subscriptions

Retro may offer in-app purchases and subscription plans. All purchases are processed through the platform you downloaded the App from (Apple App Store, Google Play, or Microsoft Store) and managed by RevenueCat.

• Billing: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Cancellations: You may cancel your subscription at any time through your platform account settings. Cancellations take effect at the end of the current billing period.
• Refunds: Refunds are subject to the refund policy of the platform through which you made your purchase. Digital Charm does not issue refunds directly.
• Price Changes: We reserve the right to change subscription prices. We will notify you of any price changes in advance.

4. Prohibited Conduct

You agree not to use the App to:

• Violate any applicable law or regulation
• Infringe the intellectual property rights of others
• Attempt to gain unauthorized access to any part of the App or its infrastructure
• Interfere with or disrupt the integrity or performance of the App
• Use automated means to access the App without our express written permission

5. Intellectual Property

All content, features, and functionality in the App — including but not limited to text, graphics, logos, icons, and software — are the exclusive property of Digital Charm and are protected by applicable intellectual property laws.

Nothing in these Terms transfers any intellectual property rights to you.

6. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

7. Limitation of Liability

To the fullest extent permitted by law, Digital Charm shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim.

8. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our sole discretion.

Upon termination, your right to use the App ceases immediately.

9. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through good-faith negotiation, and if necessary, through binding arbitration or a court of competent jurisdiction.

10. Changes to Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
